Closca Design: Legal Information

These conditions are valid for sales made by Closca Design S.L of its products offered on the website www.closca.com and/or the Water App ("hereinafter, the App"). These sales are reserved exclusively for the end user.
Making a purchase through the www.closca.com portal and/or the App implies acceptance of the general sales conditions, and written acceptance of these conditions will not be necessary.
If a customer or user does not comply with the following General Conditions, Closca Design S.L reserves the right to suspend or cancel the order and/or the customer’s account without any compensation to the customer from Closca Design S.L.
The App is available for free download from existing download portals for IOS and Android operating systems. Users acknowledge and agree to comply with all applicable terms and conditions regarding the acquisition, download, and updating of the App as determined by IOS or Android, respectively.

CLOSCA DESIGN – ARTICLE 2: PRODUCTS AND WARRANTY

The products offered by Closca Design on its website and/or the App comply with the relevant certifications for their commercialization in the available markets, as well as with the most stringent quality requirements.
Closca Design S.L ensures that the photos are an accurate and real representation of the product offered. Additionally, each product has a data sheet that includes technical specifications.
If there is an error in the description or images that implies a substantial change in the product, the customer who purchased it may return the item within 30 days of receiving it at no cost.
Closca products come with a 3-year warranty that protects against any manufacturing defects. To use the warranty, please contact support@closca.com. The team will validate whether the claim is related to a possible manufacturing defect and will offer a replacement for the damaged unit or a refund, depending on the specific circumstances of each case.


CLOSCA DESIGN – ARTICLE 3: PRICES

3.1 General

The prices of our products shown on the website (helmets, accessories, and other products) are in euros, including taxes (VAT) but excluding handling and shipping.
These costs will be indicated at the time of order validation and before payment and will be included in the invoice.
Closca Design S.L reserves the right to modify product prices at any time; however, the price to be charged will be the one in effect at the time of order registration on the website and/or the App.
Orders will not be considered complete until payment has been received by Closca Design S.L.
Closca Design S.L reserves the right to cancel the order in the following cases:

  • Orders placed at a significantly lower price due to an error that can be clearly identified as such by the customer.
  • Orders suspected of fraud.
  • Orders out of stock, even if this was not indicated on the website and in the App.
  • Orders placed in a currency different from that corresponding to the shipping address.
  • Previous unpaid orders exist. In these cases, the company will refund the full amount of the order (provided that no previous unpaid orders exist).

3.2 Orders within the European Union

The sale price has been calculated including the applicable taxes. The tax corresponds to Spain.

3.3 Orders outside the European Union

The price displayed on the website and/or the App (and charged) does not include taxes at any time. Therefore, additional payment may be required at customs, for which Closca Design will not be responsible.
Please consult your customs agent to find out the amount of these taxes.

3.4 Prices and Currency

All orders must be placed in the local currency of the place of receipt (Shipping address). However, all orders are paid in euros, so the equivalent price is applied to all currencies at the time of payment.
The available currencies are:

  • Euro – European Union
  • US Dollar – USA
  • British Pound – United Kingdom
  • US Dollar – Rest of the world

Closca Design S.L reserves the right to cancel any order placed in a currency other than the one corresponding to the shipping address.


CLOSCA DESIGN – ARTICLE 4: ORDERS

By placing an order on the website www.closca.com and/or through the App, the user acknowledges knowing and accepting these general conditions.
The order is considered placed once the order is confirmed and payment is made. However, the order is only considered firm when Closca Design has received the payment.


CLOSCA DESIGN – ARTICLE 5: AVAILABILITY

Products are available as long as they appear on the website www.closca.com and/or in the App, always subject to stock availability.
In case of out-of-stock after receiving the order, the customer will be informed by email or phone to notify them of the situation. In this case, the following options will be offered:

  • Partial shipment
  • New delivery date
  • Modify the order
  • Cancel the order.

In case of total order cancellation, a refund of the total amount paid will be issued within 30 days in the same manner as payment was made.
In case of partial cancellation, a partial refund equivalent to the canceled portion will be issued within 30 days in the same manner as payment was made.


CLOSCA DESIGN – ARTICLE 6: PAYMENT METHODS

6.1 Payment Method

Online orders can only be paid using the methods accepted and indicated on the website.
The charge to the customer's account will be made immediately, although it may not appear on the account for several days due to the customer's bank.
The order is only considered complete when the funds have been transferred to Closca Design S.L's account.
Purchases are confidential, and we use the SSL protocol to encrypt information.
Closca Design S.L does not have access to banking data, nor are these stored on any server owned by Closca Design S.L.
For this reason, all payment data must be entered each time a transaction is made on the website and/or App.
When you click the "Complete Purchase" button, our system verifies the validity of the credit card, protecting against fraud and misuse of the card. Our system classifies the risk of operations as low, medium, and high; if a medium or high level of fraud is detected, we reserve the right to verify the buyer's identity before processing the order.

6.2 Secure Payment

Closca Design S.L also verifies the trustworthiness of the data provided during registration. This is part of our commitment to protecting our customers against fraud.
Closca Design S.L has a process to verify the buyer’s data to prevent and avoid fraudulent use of banking information.
In accordance with this, Closca Design S.L reserves the right to request from the customer a copy of their proof of identity and shipping address on both sides. The order will only be shipped once these documents have been received and verified. These documents must be sent within 6 days of the request. These documents will never be sent to third parties (except for legal requirements). The customer may exercise their ARCO rights at any time in accordance with the Data Protection Law.

In the event of non-compliance with the indicated deadline, Closca reserves the right to cancel the order.


CLOSCA DESIGN – ARTICLE 7: DELIVERY OF PRODUCTS

7.1 General

The products purchased on the website and/or through the App owned by Closca Design S.L are shipped to most countries. If you want to know if we ship to your country, please contact us at support@closca.com.
Delivery times depend on preparation and transit times, which may vary by country.
The products will be delivered to the address provided during the purchase process. Closca Design reserves the right to divide a shipment into smaller ones without affecting the cost to the buyer.
Closca Design is not responsible for the consequences of a delivery delay due to transportation or customs issues. If your order has been delayed, please contact us, and we will look for the best available option.

7.2 Shipping Methods

Closca Design selects the best shipping method for each zone or region.
Transit times vary from 1 to 10 days, depending on the destination.

7.3 Delivery Issues

If the customer is not present at the time of delivery to receive the order at the address indicated at the time of placing the order, the shipping agency will contact the customer to inform them of the procedures to follow.
If the package is returned due to the impossibility of delivering it, the customer will be automatically notified by email. If no response is received from the customer within 48 hours, Closca Design S.L reserves the right to cancel the order. In this case, the shipping costs will not be refunded under any circumstances.

Once the package is received, the customer must:

  • Verify that the received items match the order.
  • Report any issues with the order, indicating if the box arrives damaged by adding a handwritten note on the delivery receipt of the shipping agency.

If there is any problem, you must contact us at support@closca.com.
Claims for transportation damages are valid within the first 24 hours and must first be made to the shipping agency.
Claims regarding the goods have a period of 7 days.
All these deadlines start from the receipt of the items. Claims of any kind will not be accepted outside the stipulated deadlines.

7.4 Delivery Delays

If an order is delayed, the customer must contact Closca Design S.L customer service by sending an email to support@closca.com.

CLOSCA DESIGN – ARTICLE 8: RIGHT OF WITHDRAWAL

8.1 Returns

In accordance with European law 2011/83/EU, the consumer (a natural person who has placed an order with Closca Design S.L. for non-commercial, industrial, or professional purposes) has a period of 14 days to exercise their right of withdrawal.
You have the right to exercise it without providing explanations and without any penalties.
The 14-day period begins from the receipt of the order. If this period ends on a Saturday, Sunday, or holiday, it will be extended to the next business day.

8.2 Exceptions

According to European Union law 2011/83/EU, the right of withdrawal cannot be exercised for orders of the following products:

  • Personalized products or those modified at the customer's request.
  • Sealed products that, at the time of return, are no longer sealed.

8.3 Returns

If the product does not meet the requirements, you can return it within 30 days of receipt, provided the following conditions are met:

  • You must return the products as soon as possible, always within 30 days of notifying your intent to return them. The products must be properly protected (if possible, in their original outer box), in perfect condition for resale (undamaged, without signs of use, etc.), and accompanied by their accessories. No stickers should be applied directly to the product box, as it is intended for presentation and not as final shipping packaging.
  • The products must not have been used, except in cases where use is necessary to verify the product's functionality. In any case, use should be minimal to ensure correct operation and without showing signs of wear.
  • Packages without identification (name, surname, address, and order number) will not be accepted. In all cases, the shipping costs for the return will be borne by the customer.

In any case, before proceeding with the return, it is ESSENTIAL to contact our customer service at support@closca.com.
The return of the products entitles you to a refund of the amount paid for them, provided that the returned product is in normal condition.
The following rules will apply:

  • The refund will always be made using the same payment method. The refund for returns will be full, with no discounts or commissions of any kind.
  • The refund period is 10 days from the moment the product is received.
  • According to banking regulations, refunds cannot be made to expired credit cards. If this occurs, Closca Design reserves the right to request additional documentation to process the refund.

    CLOSCA DESIGN – ARTICLE 9: PERSONAL DATA PROTECTION

  • In accordance with Data Protection Law, you may exercise your ARCO rights at any time by sending us an email at support@closca.com.
    Furthermore, we inform you that we use email delivery management systems and other marketing platforms, and therefore, your data may be transferred to the USA for the purpose of providing the service of processing your personal data. If you prefer to oppose this, please contact us at support@closca.com.
    Personal data (Name, address, email, and phone number) may be shared with third parties in order to ensure proper delivery.

    Cookie Policy

    We use web and app analysis services (e.g., Google Analytics or similar tools) to help the website and app analyze how users interact with the site and improve its usability. However, this data is never associated with information that could personally identify the user.
    Cookies are files sent to the browser for the purpose of recording the user's activities during their browsing time and improving navigation on the site and app. The information obtained is completely anonymous and cannot be associated with a specific identified user.

    Closca Design – ARTICLE 10: JURISDICTION

    These terms are subject to Spanish law.
    In the event of any dispute regarding the interpretation, execution, or validity of these general conditions of sale, the competent jurisdiction will be the Courts of Valencia, Spain.
    In case of a dispute, an amicable solution will be sought before any legal action is taken.

    If the local laws of the country where the purchase is made contradict these General Conditions of Sale, the general conditions will prevail, as they are based on Spanish legislation.
